What Are E-Signatures?

An e-signature (electronic signature) is a digital way to sign documents. Instead of printing a contract, signing it with a pen, scanning it back, and emailing it, clients simply type or draw their signature on screen!

Traditional signing process:

  1. Email contract to client
  2. Client prints 5-page contract
  3. Client signs with pen
  4. Client scans (or takes photos - ugh)
  5. Client emails back
  6. You save the file somewhere
  7. Hope you can find it later when needed

Time: 1-3 days (if client has a printer!)

E-signature process:

  1. Client clicks "Sign Contract" in email
  2. Reviews contract on screen
  3. Signs digitally
  4. Done!

Yes! E-signatures are fully legal and binding in the United States.

The ESIGN Act (2000)

The federal Electronic Signatures in Global and National Commerce Act, passed in 2000, established that electronic signatures are just as legally valid as handwritten signatures.

Key provisions:

  • E-signatures cannot be denied legal effect just because they're electronic
  • Electronic contracts are enforceable
  • Both parties must consent to electronic signing (by using the system)
  • Records must be retained electronically

What this means for you: When a client signs your ShootPath contract electronically, it's just as legally binding as if they signed with a pen. Courts nationwide recognize e-signatures!

State Laws

Every US state has adopted either:

  • UETA (Uniform Electronic Transactions Act) - 47 states
  • State-specific e-signature laws - 3 states (Illinois, New York, Washington)

All validate e-signatures for commercial transactions like photography contracts.

International Recognition

E-signatures are also recognized in:

  • European Union - eIDAS regulation (2016)
  • United Kingdom - Electronic Communications Act (2000)
  • Canada - PIPEDA and provincial laws
  • Australia - Electronic Transactions Act (1999)

How E-Signatures Work in ShootPath

ShootPath uses native e-signature functionality - no third-party services, no extra fees, no external accounts. Everything happens right in the client portal!

The Signing Workflow

Step 1: Contract Generation

When a client accepts your quote, ShootPath automatically:

  • Converts the quote to a job
  • Generates contract from your template
  • Fills in all template variables with job data
  • Creates unique signing link for this client

Step 2: Client Notification

Client receives email:

Once signed, you'll be able to proceed with payment.

Step 3: Contract Review

Client clicks the link and sees:

  • Full contract text
  • All details filled in with their information
  • "I agree to the terms" checkbox
  • "Sign Contract" button

They can:

  • Read the entire contract on screen
  • Scroll through all sections
  • Download a copy to review offline
  • Share with partner/spouse before signing

Step 4: Signature Capture

When ready, client clicks "Sign Contract" and chooses signature method:

Option 1: Type Signature

  • Client types their name
  • System renders it in signature font
  • Quick and easy on any device

Option 2: Draw Signature

  • Client draws signature with mouse/finger/stylus
  • Works great on tablets and phones
  • Most similar to handwritten signature

Option 3: Upload Signature

  • Client uploads image of handwritten signature
  • Good for clients who have scanned signatures
  • Maintains their actual signature appearance

Step 5: Confirmation

After signing:

  • Client sees confirmation message
  • Client receives signed PDF via email immediately
  • You (photographer) receive notification
  • You (photographer) receive signed PDF via email
  • Signed contract stored in job record automatically

Step 6: Payment Unlocked

Now that contract is signed:

  • Client can access invoice
  • Payment buttons become active
  • Client can pay deposit/balance
  • Workflow continues!

Opening the Contract Portal

Client clicks the button and lands on the contract signing page:

Top of page shows:

  • Your business logo
  • "Photography Services Agreement" heading
  • Job details summary box (session date, location, total)
  • Progress indicator: "Step 1 of 2: Review Contract"

Main area shows:

  • Full contract text
  • Properly formatted with headings and sections
  • All variables filled in with their specific information
  • Easy to read on mobile or desktop

Bottom of page shows:

  • "Download a Copy" button (they can save PDF)
  • "I have read and agree to the terms" checkbox
  • "Sign Contract" button (greyed out until checkbox is clicked)

Reviewing the Contract

Clients can:

Read on screen - Scroll through the entire agreement, clearly formatted

Search - Use browser search (Ctrl+F / Cmd+F) to find specific terms like "cancellation" or "delivery"

Download - Click "Download a Copy" to save unsigned PDF for offline review

Share - Send link to spouse/partner to review together

Discuss - Reply to your email with questions before signing

Most clients skim the contract, focusing on:

  • Payment terms (when payments are due)
  • Delivery timeline (when they get photos)
  • Cancellation policy (what if weather/emergency)
  • Usage rights (can they print? share? post?)

Average review time: 5-10 minutes

Signing the Contract

When ready, client:

  1. Checks the box - "I have read and agree to the terms"
  2. Clicks "Sign Contract" - Button becomes active
  3. Selects signature method - Modal appears with three options

Type Signature Tab:

  • Text input: "Type your full name"
  • Client types "Sarah Johnson"
  • Preview shows name in elegant signature font
  • "Use This Signature" button

Draw Signature Tab:

  • Canvas area with "Sign here" placeholder
  • Client draws signature with mouse/finger/stylus
  • "Clear" button if they want to redo
  • "Use This Signature" button

Upload Signature Tab:

  • "Choose File" button
  • Client selects image from computer/phone
  • Preview shows uploaded signature
  • "Use This Signature" button

Signature Audit Trail

Every e-signature in ShootPath includes a complete audit trail for legal protection. If you ever need to prove a contract was signed, you have:

Captured data:

  • Who signed: Client name and email
  • When signed: Date and exact time (with timezone)
  • Where signed: IP address and approximate location
  • What was signed: Exact contract version (stored forever)
  • How they signed: Typed, drawn, or uploaded signature

Why audit trails matter:

If a client disputes signing the contract, you can prove:

  • They accessed the contract (IP address and timestamp)
  • They agreed to the terms (checkbox confirmation)
  • They provided a signature (image captured)
  • The exact terms they agreed to (PDF stored)

Courts recognize this level of documentation as strong evidence!

Security and Privacy

ShootPath takes contract security seriously:

Secure Transmission

HTTPS encryption - All contract data is transmitted via encrypted connections. Clients can't be intercepted while signing.

Unique tokens - Each contract link contains a unique, non-guessable token. Only the client with the link can access their contract.

Token expiration - Links can be set to expire after acceptance (optional), preventing unauthorized access later.

Secure Storage

Encrypted at rest - Signed contracts are stored encrypted on secure servers.

Redundant backups - Multiple backup copies ensure contracts are never lost.

Permanent retention - Signed contracts are kept indefinitely (you can't accidentally delete them).

Access Control

Client access - Only the specific client can access their contract (via unique token).

Your access - Only you (photographer) can view signed contracts for your jobs.

No public access - Contracts are never indexed by search engines or accessible without authentication.

Common E-Signature Questions

Q: Are e-signatures as legally binding as wet ink signatures?

A: Yes! The ESIGN Act (2000) established that e-signatures have the same legal status as handwritten signatures in the United States. Courts nationwide recognize e-signatures.


Q: What if a client doesn't have email or internet access?

A: E-signatures require internet access to sign. For clients without email/internet:

  1. Print the contract
  2. Have them sign physically
  3. Scan and upload to the job record

ShootPath supports both e-signatures and physical signatures!


Q: Can a client claim they didn't sign the contract?

A: The audit trail makes this very difficult. You have:

  • Their email address (they received the link)
  • Timestamp of signature
  • IP address (proves they accessed it)
  • Signature image they created

This is actually stronger evidence than a handwritten signature (which can be forged!).


Q: What if the client's spouse/partner needs to sign too?

A: Currently, ShootPath supports one client signature per contract. For dual signatures:

Option 1: Have both people present when signing (one person signs on behalf of both)

Option 2: Add both names to the client record ("Sarah & Michael Johnson"), and one person signs on behalf of both

Option 3: Use a physical contract requiring two signatures

Most photographers don't require dual signatures, but if you need this, reach out to support!


Q: How long are signed contracts stored?

A: Forever! Signed contracts are stored indefinitely as part of your job records. Even if you delete the job (please don't!), the signed contract remains archived.


Q: Can I download signed contracts?

A: Yes! Download signed PDFs anytime from the job record. You can:

  • Save to your computer
  • Include in client deliverables
  • Send to your lawyer if needed
  • Print physical copies

Q: What if a client signs by accident?

A: Contact them immediately and discuss. You can:

  1. Void the contract and have them sign a new one
  2. Create an addendum addressing concerns
  3. Mutually agree to cancel

Document everything in writing! If they genuinely made an error, work with them professionally.


Q: Do clients need to create an account to sign?

A: No! Clients sign via unique links sent to their email. No account creation, no passwords, no extra steps. Just click, review, sign!


Q: Can clients sign on mobile devices?

A: Absolutely! The signing interface is fully responsive:

  • Phones - Touch to draw signature
  • Tablets - Stylus or finger for drawing
  • Desktops - Mouse to draw, or type signature

Most clients sign on phones these days!


Q: What if a client loses the email with the contract link?

A: You can resend the contract link from the job record. Click "Resend Contract" and they'll get a fresh email with the same link!

Troubleshooting E-Signatures

Problem: Client says they didn't receive the contract email

Possible causes:

  • Email went to spam folder
  • Wrong email address in client record
  • Email delivery delay

Solutions:

  1. Ask client to check spam/junk folder
  2. Verify correct email in client record (Settings → Clients)
  3. Click "Resend Contract" in job record
  4. Send them the portal link manually (copy from job record)

Problem: Client can't see the "Sign" button

Possible causes:

  • Didn't check "I agree to terms" checkbox
  • Browser JavaScript disabled
  • Using extremely outdated browser

Solutions:

  1. Ask them to check the "I agree" box first
  2. Try a different browser (Chrome, Safari, Firefox)
  3. Try on a different device (phone instead of computer)
  4. If all else fails, send a physical contract

Problem: Client says signature looks weird

Possible causes:

  • Used typed signature (rendered in signature font)
  • Drew signature with mouse (hard to control)
  • Uploaded low-quality image

Solutions:

  1. Have them re-sign using drawn method on touch device (phone/tablet)
  2. Or upload a higher-quality image of their signature
  3. Explain that typed signatures are legally valid even if they look "digital"

Problem: Client wants to change something after signing

Possible causes:

  • Found error in contract
  • Circumstances changed
  • Wants different terms

Solutions:

  1. Minor errors (typo in address) - Create addendum correcting the error
  2. Terms change (client upgrades package) - Send new quote, which creates new contract
  3. Circumstance change (reschedule) - Follow cancellation/rescheduling policy in original contract

Never modify a signed contract! Either create an addendum or issue a new contract.


Problem: Signed PDF won't download

Possible causes:

  • Browser blocking download
  • PDF generation error
  • Slow internet connection

Solutions:

  1. Try right-click → "Save Link As..."
  2. Try different browser
  3. Contact ShootPath support for manual PDF delivery

E-Signature Best Practices

1. Send Contracts Quickly

After a client accepts your quote, send the contract immediately. The faster you move, the less likely clients are to change their minds!

Automatic is best: ShootPath sends contracts automatically when quotes are accepted. No manual work!

Follow-up: If contract isn't signed within 24 hours, send a friendly check-in: "Hi Sarah! Just checking in - did you have any questions about the contract? Happy to clarify anything!"

2. Make Contracts Easy to Read

Do:

  • Use clear headings and sections
  • Break text into short paragraphs
  • Use bullet points for lists
  • Write in plain English
  • Include a summary box at the top (key terms)

Don't:

  • Use legal jargon unnecessarily
  • Create giant walls of text
  • Use tiny fonts
  • Make it intimidating

The easier your contract is to read, the faster clients will sign!

3. Be Available for Questions

Some clients will have questions before signing:

Common questions:

  • "What's your cancellation policy if it rains?" → Point to weather clause
  • "When will we get the photos?" → Point to delivery timeline
  • "Can we use photos for business cards?" → Explain usage rights
  • "What if we need to reschedule?" → Point to rescheduling terms

Best response approach:

  • Answer quickly (within a few hours)
  • Point to specific contract section
  • Offer to hop on a call if complex
  • Be patient and friendly!

4. Never Pressure Clients to Sign

Bad:

"I need this signed TODAY or I'm giving your date to someone else!"

Good:

"Take your time reviewing the contract! Let me know if you have questions. I'm holding your date until [reasonable deadline]."

Pushy tactics create bad client relationships. Give them a reasonable timeframe (3-5 days), then follow up professionally.

5. Explain Why E-Signatures Are Safe

Some clients (especially older ones) are wary of e-signatures. Educate them:

"E-signatures are just as legally binding as handwritten signatures - they've been federally recognized since 2000! It's the same system used by banks, real estate agents, and lawyers. Plus, it's faster and more convenient for both of us!"

Most clients appreciate the convenience once they understand it's legitimate!

6. Keep Signed Contracts Accessible

Do:

  • Store in job records (ShootPath does this automatically)
  • Download backup copies to your computer
  • Keep backups in cloud storage (Dropbox, Google Drive)

Don't:

  • Rely only on email attachments
  • Delete signed contracts (you might need them years later!)
  • Store only on one device (what if your computer crashes?)

You might need signed contracts for:

  • Tax audits (years later)
  • Copyright disputes
  • Insurance claims
  • Legal proceedings

Keep them forever!

Recommendation: Use e-signatures by default. Offer physical signatures only if:

  • Client specifically requests it
  • Client has no email/internet access

Once a contract is signed, the workflow continues:

1. Payment Becomes Available

Before signing:

  • Invoice exists but payment buttons are disabled
  • Client sees "Contract must be signed before payment"

After signing:

  • Payment buttons become active
  • Client can pay deposit, balance, or full amount
  • Payment page links to signed contract for reference

2. Job Status Updates

Job record shows:

  • Contract Status: Signed ✅
  • Ready for Payment: Yes
  • Next Action: Collect deposit

3. Automated Communications

Depending on your workflow settings:

  • Client receives invoice email (if not sent already)
